Overview

Welcome to TCGFIX. The terms “TCGFIX,” “we,” “us,” and “our” refer to TCGFIX.

TCGFIX operates this website and online store, including its related information, content, features, products, event registrations, and services (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

If you do not agree to these Terms of Service or our Privacy Policy, you should not access or use the Services.

1. Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you have permission from a parent or legal guardian.

You may be asked to provide information such as your name, email address, billing information, payment information, shipping address, or event-attendee information. You agree that the information you provide will be accurate, current, and complete.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

2. Products and Product Information

We make reasonable efforts to accurately display and describe our products. Product colors, packaging, artwork, promotional materials, and other characteristics may appear differently depending on your device, display settings, manufacturer changes, or product-printing variations.

Trading cards and other collectible products may contain randomized contents. Unless expressly stated otherwise, purchasing a randomized or sealed product does not guarantee that it will contain any particular card, rarity, treatment, value, or collectible.

Product prices and secondary-market values may rise or fall. TCGFIX does not guarantee the future resale value, collectability, investment performance, or market price of any product.

We may change product descriptions, prices, availability, purchase limits, or other information at any time. We may also discontinue products or limit quantities available to any customer, household, geographic region, or order.

3. Orders

Submitting an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing errors, inventory errors, payment problems, purchase-limit violations, or suspected unauthorized resale activity.

An order is not final until payment has been successfully processed and the order has been accepted by TCGFIX.

Please review your order before submitting it. We may be unable to change or cancel an order after processing or fulfillment has begun.

If we decline, modify, or cancel an order, we will attempt to notify you using the email address, telephone number, billing information, or other contact information supplied with the order.

4. Prices, Payments, and Promotions

Prices, discounts, purchase limits, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of clear pricing or technical errors.

Unless otherwise stated, displayed prices do not include applicable taxes, shipping charges, customs duties, import charges, or handling fees.

You agree to provide accurate and complete payment and billing information. You represent that you are authorized to use the payment method submitted with your order.

Discount codes and promotional offers:

  • Must be used according to their stated conditions;

  • May have expiration dates, customer limits, or product restrictions;

  • May not be combined unless expressly permitted;

  • May be canceled or refused in cases of misuse, fraud, or technical error; and

  • Have no cash value unless required by law.

Event discounts, including group-registration offers, apply only according to the conditions stated on the applicable event page or promotion.

5. Shipping and Delivery

Delivery dates and transit times are estimates and are not guaranteed. Shipping delays may occur because of carriers, weather, customs processing, incorrect addresses, service interruptions, or events outside our reasonable control.

Customers are responsible for supplying a complete and accurate shipping address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer where permitted by law.

If an order appears to be lost, damaged, or incorrectly delivered, contact us promptly so that we can investigate the shipment and determine the appropriate resolution. We may request photographs, packaging, tracking information, or other reasonable documentation.

International customers are responsible for applicable customs duties, taxes, brokerage charges, and import requirements unless expressly stated otherwise.

6. Event Registrations

TCGFIX organizes and promotes trading-card events at various partner venues. Event dates, start times, locations, formats, prices, capacities, included products, prize structures, and other event-specific details are listed on the applicable event page.

Advance online registration is required unless the event listing expressly permits walk-ins. Adding an event to your cart does not reserve a seat. A seat is reserved only after checkout is completed and payment is accepted.

You are responsible for reviewing the event’s date, time, city, venue, format, and eligibility requirements before registering.

We may reasonably change an event’s schedule, venue, format, capacity, prize structure, or other details when circumstances require. We will attempt to notify registered participants of material changes using the contact information supplied during checkout.

If TCGFIX cancels an event, affected customers will receive a refund of the registration fee paid to TCGFIX. Unless required by law, TCGFIX is not responsible for transportation, lodging, meals, lost wages, or other incidental expenses associated with attending an event.

Participants must:

  • Follow instructions from event organizers and venue staff;

  • Follow the rules of the applicable game and tournament format;

  • Treat other participants, organizers, venue employees, and guests respectfully;

  • Avoid threatening, harassing, discriminatory, disruptive, or unsafe conduct; and

  • Follow all applicable venue policies.

TCGFIX may remove or disqualify a participant for cheating, theft, harassment, violence, intentional property damage, serious disruption, or other unsafe or abusive conduct. Refund eligibility following removal will be determined under our Refund Policy and applicable law.

A parent or legal guardian is responsible for determining whether an event is appropriate for a minor participant and for arranging any supervision the minor requires.

7. Event Prizes and Promotional Items

Event prizes, promotional items, participation items, and other benefits are provided according to the applicable event listing and are subject to availability and eligibility requirements.

Participants must satisfy the stated event requirements to receive prizes or promotional items. Unless the event listing states otherwise, participants who do not attend or complete the required portion of an event may not be eligible for attendance-based items.

We may substitute a prize or promotional item with a reasonably comparable item when the originally advertised item becomes unavailable for reasons outside our reasonable control.

8. Intellectual Property

The Services, including their text, graphics, logos, photographs, videos, designs, layout, and original content, are owned by TCGFIX or used with permission and are protected by applicable intellectual-property laws.

Magic: The Gathering, related game names, artwork, symbols, card images, and trademarks belong to their respective owners. References to third-party games or products do not imply ownership by TCGFIX or endorsement by the applicable rights holder unless expressly stated.

You may use the Services for lawful, personal, and noncommercial purposes. You may not reproduce, distribute, republish, modify, publicly display, commercially exploit, or create derivative works from TCGFIX-owned content without prior written permission.

9. Third-Party Services and Links

The Services may include links to, integrations with, or features operated by third parties, including Shopify, payment processors, shipping carriers, social-media services, event venues, and game-registration platforms.

We are not responsible for the content, security, availability, accuracy, or practices of independent third-party websites or services. Your use of third-party services may be governed by separate terms and privacy policies.

Please review the applicable third party’s policies before submitting information or completing a transaction through its services.

10. Relationship With Shopify

TCGFIX is powered by Shopify, which provides the ecommerce technology used to offer the Services.

Sales and purchases made through our store are transactions directly between you and TCGFIX. Shopify is not the seller of products or event registrations offered by TCGFIX and is not responsible for fulfillment, event operations, product quality, injuries, losses, or disputes arising from purchases made from TCGFIX.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising directly from your transactions with TCGFIX.

11. Privacy

Personal information collected through the Services is governed by our Privacy Policy:

Because Shopify hosts our online store, Shopify may collect and process information relating to your access to and use of the Services. Shopify’s applicable privacy information is available at:

Information may also be processed by payment providers, shipping providers, analytics services, advertising services, and other partners necessary to operate the Services.

12. Reviews, Feedback, and Submitted Content

If you submit a review, photograph, comment, suggestion, or other content to TCGFIX, you represent that you have the right to submit it and that it does not violate another person’s rights.

You grant TCGFIX a nonexclusive, worldwide, royalty-free license to use, reproduce, display, publish, edit, and distribute submitted content for operating, improving, and promoting the Services.

We may remove submitted content that we reasonably believe is unlawful, fraudulent, abusive, misleading, defamatory, obscene, infringing, or otherwise inappropriate.

You remain responsible for the accuracy and legality of content you submit.

13. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccurate descriptions, incorrect prices, inventory errors, event-detail errors, or omissions.

We may correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted. If we cancel a paid order because of our error, we will issue an appropriate refund.

14. Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any applicable law or regulation;

  • Commit fraud or submit false or misleading information;

  • Infringe intellectual-property, privacy, or other legal rights;

  • Harass, threaten, abuse, impersonate, or harm another person;

  • Transmit malware or malicious code;

  • Interfere with the operation or security of the Services;

  • Attempt to gain unauthorized access to accounts, systems, or data;

  • Circumvent purchase limits, access controls, fraud controls, or security measures;

  • Collect personal information about others without authorization;

  • Send spam or unauthorized promotional messages; or

  • Conduct unauthorized automated access, excessive scraping, or data extraction that disrupts the Services or circumvents technical restrictions.

This section does not prohibit ordinary indexing by authorized search engines, accessibility tools, customer-authorized browser tools, or automated services authorized by TCGFIX.

We may suspend or terminate access when we reasonably determine that these Terms have been violated.

15. Termination

We may suspend or terminate access to the Services when reasonably necessary to protect TCGFIX, our customers, our partners, or the integrity and security of the Services.

Termination does not eliminate payment obligations or liabilities that arose before termination.

Provisions that should reasonably survive termination—including intellectual property, privacy, disclaimers, limitations of liability, indemnification, dispute provisions, and governing law—will continue to apply.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for warranties expressly provided by TCGFIX or warranties that cannot legally be excluded.

We do not guarantee that the Services will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms excludes or limits any warranty, consumer right, or remedy that cannot legally be excluded or limited.

17. Limitation of Liability

To the fullest extent permitted by law, TCGFIX and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from the Services, products, event registrations, or these Terms.

This limitation does not apply to liability that cannot legally be excluded or limited.

Nothing in these Terms limits rights or remedies available to consumers under applicable law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TCGFIX and its owners, employees, contractors, partners, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Your material violation of these Terms;

  • Your unlawful use of the Services;

  • Your violation of another person’s rights; or

  • Content you submit through the Services.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary. The remaining provisions will continue in effect.

20. Waiver and Entire Agreement

A failure by TCGFIX to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, event listings, and other policies expressly incorporated by reference, constitute the agreement between you and TCGFIX regarding the Services.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, reorganization, sale of the business, transfer of assets, or similar transaction.

22. Governing Law

These Terms and any separate agreements through which we provide Services are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms shall be brought in the appropriate state or federal courts located in Alameda County, California, and the parties consent to jurisdiction and venue in those courts, except where applicable law provides otherwise.

23. Changes to These Terms

We may update these Terms by posting a revised version on this page.

Material changes will take effect on the date stated in the updated Terms or as otherwise required by law. Your continued use of the Services after an updated version takes effect constitutes acceptance of the revised Terms.
